I. Verification of Certificate of Property Rights
When you purchasing land in Cambodia, the buyer needs to verify the land title certificate in the Land Bureau of the Ministry of Land, Urban Planning and Construction of Cambodia in order to check whether there is a debt on the land. The steps as follows:
The buyer receives the title certificate from the seller.
The buyer shall verify the title certificate in the land bureau.
If the land in debt, mortgage or lawsuit, the Land Bureau will notify the buyer.
II. Access to Detailed Information about Real Estate
Buyers are required to obtain detailed information about the property from township/district officials. In addition, in order to obtain specific information, the buyer must consult the location where the property is purchased.
III.Access to relevant official documents
If the landowner is a artificial person, the buyer must have the following documents:
A copy of the identity title certificate of the owner or representative of the company.
Certificate of company registration approved by the Ministry of Commerce.
Other official documents relating to and dealing with the seller's company, all of which are intended to verify the name of the company appearing on the title certificate in order to ensure accuracy and consistency.
Power of attorney.
Authorization to individuals (sellers) signed by the board of directors of the company allows them to represent the company to the Land Administration.
The power of attorney clearly stipulates that the seller has the right to transfer the ownership of the land to the buyer.
IV. Apply for Registration in the Land Bureau
If the buyer and seller (whether individual or company) want to complete the property right transaction, they must go to the Land Bureau to prepare and sign the relevant documents. To complete this step, you need to provide the following documents:
Regulation of Company
Certificate of Company (obtained in step 3).
Two proxy documents (obtained in step 3).
When you signing the transfer agreement, the Seller shall display the original property right certificate in the land bureau to transfer the property right to the new owner.
V. Taxation
Land transfer tax is 4% of the land price, which needs to be handed over to the Ministry of Finance and Economics of Cambodia. The place of payment is the tax bureau. After payment, you will receive a tax certificate receipt.
VI. Return to the Land Bureau to complete the registration procedure
After completing the tax payment, the two parties may return to the District Land Administration Office to sign or press their handprints on the documents of the Ministry of Urban Planning and Construction.
All signatures must be witnessed by local authorities, such as township/district governors, and witnesses must press their fingerprints.
VII. Obtaining a Certificate of Property Rights
Obtain the certificate of property right from the land bureau: the district/county Land Management Office will issue all "transfer documents" to the land bureau, and the Land Bureau will issue the final certificate of property right in the name of the new owner.
The above seven steps are the complete process of land purchase in Cambodia. The specific operation time varies according to the situation.
